AMIR TAYYEBI INC., doing business as OmniPROTEX® (“OmniPROTEX,” “we,” “us,” or “our”), manufactures and sells personal ballistic protective equipment and related accessories. By accessing this website, purchasing, wearing, or using any OmniPROTEX® product, you acknowledge and agree to the following terms and limitations.
1. NO GUARANTEE OF PROTECTION OR SURVIVAL
No body armor is bulletproof. No body armor provides complete or absolute protection against injury or death. Ballistic and stab-resistant body armor reduces certain risks but does not eliminate them. Serious injury or death may still occur while wearing OmniPROTEX® products, even when the product performs as designed.
2. ASSUMPTION OF RISK
The use of body armor involves inherent and unpredictable risks, including but not limited to ballistic impact, blunt force trauma, penetration, fragmentation, and secondary injuries. By purchasing, wearing, or using OmniPROTEX® products, the user knowingly and voluntarily assumes all risks, whether foreseeable or unforeseeable, associated with the use of such products.
3. BALLISTIC TESTING & PERFORMANCE LIMITATIONS
OmniPROTEX® products are tested under controlled laboratory conditions in accordance with applicable National Institute of Justice (NIJ) ballistic standards, including, where applicable, NIJ Standard-0101.06 and/or NIJ Standard-0101.07, as applicable to specific models.
Actual performance in real-world conditions may vary due to factors including, but not limited to:
• Ammunition type, velocity, mass, construction, and caliber
• Impact angle and location
• Multi-hit spacing
• Edge strikes and oblique impacts
• Environmental conditions
• Product age, wear, or damage
Laboratory test results do not guarantee identical performance in real-world scenarios.
4. NIJ CERTIFICATION SCOPE
Where applicable, NIJ certification applies only to the specific model, size, material configuration, and construction tested. Any modification, alteration, trimming, folding, cutting, sewing, or unauthorized repair of armor panels or carriers voids certification, warranty, and any implied protection.
NIJ certification does not guarantee survivability or freedom from injury.
5. THREAT COVERAGE LIMITATIONS
Unless expressly stated and certified, OmniPROTEX® soft body armor is not designed or certified to defeat:
• Rifle threats
• Armor-piercing ammunition
• Steel-core or tungsten-core projectiles
• Incendiary or explosive projectiles
• Fragmentation from explosives
• Unconventional, modified, or hand-loaded ammunition
• Any threats exceeding applicable NIJ test parameters
Stab and slash resistance, where applicable, is limited to tested conditions and does not guarantee protection from all edged or pointed threats.
6. BLUNT FORCE TRAUMA & SECONDARY INJURIES
Even when a projectile or threat is stopped, the wearer may suffer blunt force trauma, including but not limited to bruising, broken ribs, internal bleeding, organ damage, spinal injury, or death, including injuries occurring even when the armor performs as intended. OmniPROTEX® is not responsible for injuries resulting from blunt force or energy transfer.
7. FIT, COVERAGE & USER RESPONSIBILITY
Proper sizing, fit, and placement are the sole responsibility of the user. Body armor only protects the areas it covers. Gaps in coverage are inherent to all wearable armor systems. Improper fit, movement, or positioning may expose unprotected areas and reduce effectiveness.
8. CARE, MAINTENANCE & SERVICE LIFE
Ballistic armor panels are not washable and must not be submerged, machine-washed, or exposed to harsh chemicals. Improper cleaning, maintenance, storage, or handling may degrade performance and void the warranty.
Armor performance may degrade due to:
• Heat exposure (including storage in vehicles or trunks)
• Moisture, sweat, or humidity
• UV exposure
• Chemical exposure
• Folding, creasing, or compression
Users are responsible for following all care and storage instructions provided by OmniPROTEX®.
9. MODIFICATIONS & MISUSE
Any modification, alteration, or misuse of OmniPROTEX® products voids all warranties and releases OmniPROTEX® from all liability to the fullest extent permitted by law. Products are intended for lawful defensive use only and are not designed for repeated live-fire training, military combat, or explosive environments unless explicitly stated.
10. MEDICAL DISCLAIMER
OmniPROTEX® products are not medical devices and do not provide medical treatment or health guarantees. Users with medical conditions should consult a qualified healthcare professional prior to use.
11. WARRANTY LIMITATIONS
All products are subject to OmniPROTEX®’s Limited Warranty as published on this website. To the maximum extent permitted by law, all implied warranties, including warranties of merchantability and fitness for a particular purpose, are disclaimed beyond the express written warranty.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, OmniPROTEX® shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use its products. In no event shall OmniPROTEX®’s total liability exceed the original purchase price of the product.
13. LEGAL COMPLIANCE & EXPORT CONTROLS
Body armor products may be subject to U.S. export control laws and regulations, including, where applicable, the Export Administration Regulations (EAR). The purchaser is solely responsible for compliance with all applicable federal, state, and local laws and regulations.
14. CONTENT & SPECIFICATIONS DISCLAIMER
Product specifications, descriptions, images, and marketing materials are subject to change without notice. Images are for illustrative purposes only.
15. GOVERNING LAW
This Disclaimer shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located within the State of Georgia.
16. ACCEPTANCE OF TERMS
By purchasing, wearing, or using OmniPROTEX® products, you acknowledge that you have read, understood, and agreed to this Disclaimer in its entirety.
