WARRANTY
Customer Care Department
This Limited Warranty applies to products manufactured and sold by AMIR TAYYEBI INC., doing business as OmniPROTEX® (“OmniPROTEX,” “we,” “us,” or “our”).
This Warranty applies only to the original end user and is valid only with proof of purchase.
1. WARRANTY — OUTER CARRIER & NON-BALLISTIC COMPONENTS
1.1 Warranty Coverage
The outer carrier, vest, jacket, and other non-ballistic components are warranted to be free from defects in materials and workmanship for a period of one (1) year from the original date of purchase or issue to the end user, as verified by valid proof of purchase.
1.2 Remedy
During the warranty period, any outer carrier or non-ballistic component determined by OmniPROTEX® to have a defect in materials or workmanship will be repaired or replaced at no cost, at OmniPROTEX®’s discretion.
1.3 Exclusions
This warranty does not cover:
- Normal wear and tear
- Cosmetic wear, fading, abrasion, fraying, or surface damage resulting from normal use
- Alteration or modification
- Abuse, misuse, or improper use
- Improper storage
- Improper cleaning or maintenance
- Accidental damage
- Damage caused by unauthorized repair
- Damage resulting from failure to follow provided care and cleaning instructions
Normal deterioration resulting from routine use is not considered a manufacturing defect.
2. WARRANTY — SOFT BALLISTIC ARMOR PANELS
2.1 Ballistic Performance Warranty
The soft ballistic body armor panels are warranted to meet the ballistic performance level identified on the product label for a period of five (5) years from the date of issue to the original end user, as verified by proof of purchase or applicable warranty records.
2.2 NIJ Certification Statement
Where applicable, ballistic armor models may be tested and certified in accordance with the applicable National Institute of Justice ballistic resistance standard.
For models certified under NIJ Standard-0101.06, certification applies only to the specific model, configuration, and construction covered by the applicable certification.
NIJ certification does not guarantee protection from injury or death.
2.3 Construction Consistency
Soft ballistic panels are warranted to be manufactured to the material construction and performance requirements applicable to the model identified on the product label.
Minor manufacturing or design variations that do not adversely affect the intended ballistic performance may occur.
3. CONDITIONS & LIMITATIONS OF BALLISTIC WARRANTY
This warranty is conditioned upon proper use, care, and storage of the ballistic panels. Coverage may be denied if the panel has been:
- Cut, torn, punctured, folded, creased, or altered
- Abused or misused
- Improperly installed or worn outside its intended carrier
- Excessively exposed to moisture or liquids
- Exposed to excessive heat
- Improperly stored under excessive heat, humidity, pressure, or compression
- Subjected to unauthorized repair or modification
Ballistic panels should be inspected regularly and must not be used if their integrity appears compromised.
4. WARRANTY REMEDY — BALLISTIC COMPONENTS
4.1 Manufacturing or Material Defects
During the warranty period, any soft ballistic panel determined by OmniPROTEX® to have a manufacturing or material defect will be repaired or replaced at no cost, at OmniPROTEX®’s discretion.
4.2 Panel Cover Damage
If the outer cover of a soft ballistic panel becomes cut, torn, frayed, punctured, or otherwise compromised, the panel must not be worn until it has been evaluated by OmniPROTEX®.
Panel-cover damage resulting from a manufacturing or material defect may be repaired or replaced under warranty.
Damage resulting from normal wear and tear, improper care, storage, misuse, abuse, accidental damage, or other non-warranty causes may be repaired or replaced at the customer’s expense.
OmniPROTEX® will advise the customer of any applicable repair or replacement costs before proceeding.
5. LIMITATIONS OF PROTECTION
Soft ballistic armor is designed to reduce the risk of serious injury only in the areas covered by the armor.
No body armor can provide protection against every projectile, weapon, impact condition, shot angle, velocity, or circumstance.
Soft body armor is not bulletproof, and no guarantee of survivability or freedom from injury is expressed or implied.
6. WARRANTY EXCLUSIONS & DISCLAIMERS
This Warranty:
- Applies only to the original end user
- Is non-transferable
- Does not cover normal wear and tear unless expressly stated otherwise
- Does not cover cosmetic damage
- Does not cover damage caused by accidents, negligence, misuse, abuse, improper maintenance, or unauthorized repair
- Does not cover incidental or consequential damages to the extent permitted by applicable law
Except as expressly stated herein, no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, are made, except where such exclusions are prohibited by applicable law.
7. WARRANTY SERVICE
To initiate a warranty claim, contact the OmniPROTEX® Customer Care Department before returning any product.
Returned products must include proof of purchase and any return authorization required by OmniPROTEX®.
Unauthorized returns may be refused.
OmniPROTEX® may require inspection of the product before determining whether a claimed condition is covered by warranty.
8. GOVERNING LAW
This Warranty shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.
