WARRANTY

This Limited Warranty applies to products manufactured and sold by AMIR TAYYEBI INC., doing business as OmniPROTEX® (“OmniPROTEX,” “we,” “us,” or “our”).

This Warranty applies only to the original end user and is valid only with proof of purchase.

1. WARRANTY — OUTER CARRIER & NON-BALLISTIC COMPONENTS

1.1 Warranty Coverage

The outer carrier (also referred to as the “jacket” or "vest") and other non-ballistic components are warranted to be free from defects in materials and workmanship for a period of ninety (90) days from the original date of issue to the end user, as verified by a valid purchase receipt.

1.2 Remedy

During the warranty period, any outer carrier or non-ballistic component found to have a manufacturing or material defect, as determined solely by an authorized OmniPROTEX® representative upon inspection, will be repaired or replaced at no cost to the customer, at OmniPROTEX®’s discretion.

1.3 Exclusions

This warranty does not apply to products that have been:

Altered or modified
Abused or misused
Improperly stored
Improperly cleaned or maintained
Subjected to normal wear and tear

Failure to follow provided care and cleaning instructions voids this warranty.

2. WARRANTY — SOFT BALLISTIC ARMOR PANELS

2.1 Ballistic Performance Warranty

The soft ballistic body armor panels are warranted to meet the NIJ Standard-0101.06 Level IIIA ballistic performance identified on the product label for a period of five (5) years from the date of issue to the original end user, as verified by a completed warranty card or proof of purchase.

2.2 NIJ Certification Statement

Where applicable, the ballistic elements of this system were tested in accordance with the requirements of NIJ Standard-0101.06 for ballistic resistance of personal body armor. NIJ certification applies only to the specific model, size, and configuration tested.

NIJ certification does not guarantee protection from injury or death.

2.3 Construction Consistency

The soft ballistic panels are warranted to be of the same material construction and performance classification as the original model identified on the product label. Minor variations in design, panel geometry, or construction method that do not affect certified ballistic performance may occur.

3. CONDITIONS & LIMITATIONS OF BALLISTIC WARRANTY

This warranty is expressly conditioned upon strict compliance with all care, use, and storage requirements. The warranty shall be void if any of the following occur:

The panel is cut, torn, punctured, folded, creased, or altered
The panel is abused or misused
The panel is improperly installed or worn outside its intended carrier
The panel is excessively exposed to moisture or liquids
The panel is exposed to excessive heat (including storage in vehicles or trunks)
The panel is improperly stored (excessive heat, humidity, or compression)

4. WARRANTY REMEDY — BALLISTIC COMPONENTS

4.1 Manufacturing or Material Defects

During the warranty period, any soft ballistic panel determined by OmniPROTEX® to have a manufacturing or material defect will be repaired or replaced at no cost, at OmniPROTEX®’s discretion.

4.2 Panel Cover Damage

If the outer cover of a soft ballistic panel becomes cut, torn, frayed, or otherwise compromised, the panel must not be worn and should be returned to OmniPROTEX® immediately for inspection.

Damage resulting from normal wear and tear will be repaired at no cost
Damage resulting from improper care, storage, misuse, or abuse, as determined solely by OmniPROTEX®, may result in repair or replacement at the customer’s expense

OmniPROTEX® will advise the customer of any applicable repair or replacement costs prior to proceeding.

5. LIMITATIONS OF PROTECTION

Soft ballistic armor panels are designed to reduce the risk of serious injury only in the areas they cover. No protection is provided for uncovered areas.

Soft body armor is not bulletproof, and no guarantee of survivability or freedom from injury is expressed or implied.

6. WARRANTY EXCLUSIONS & DISCLAIMERS

This Warranty:

Applies only to the original end user
Is non-transferable
Does not cover cosmetic damage
Does not cover damage caused by accidents, negligence, or unauthorized repair
Does not cover incidental or consequential damages

Except as expressly stated herein, no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, are made.

7. WARRANTY SERVICE

To initiate a warranty claim, contact the OmniPROTEX® Customer Care Department prior to returning any product. Returned products must be accompanied by proof of purchase and authorization from OmniPROTEX®.

Unauthorized returns may be refused.

8. GOVERNING LAW

This Warranty shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.
